Many businesses across the UAE have already received the AED 10,000 administrative penalty for late Corporate Tax registration and assume there is no further action they can take.
Fortunately, that may not be the case.
The Federal Tax Authority (FTA) has introduced a Corporate Tax Late Registration Penalty Waiver Initiative to encourage voluntary compliance and provide eligible businesses with an opportunity to have the penalty waived or refunded, subject to meeting the prescribed conditions.
For many businesses, 31 July 2026 is a critical dateānot because it is the general Corporate Tax filing deadline, but because it may determine eligibility for the FTA’s penalty waiver initiative.
Businesses required to register for UAE Corporate Tax that fail to submit their registration application within the prescribed timeline may be subject to an administrative penalty of AED 10,000.
To support businesses and promote voluntary compliance, the UAE Cabinet introduced a penalty waiver initiative, which is administered by the FTA. Eligible businesses that satisfy the required conditions can have this penalty automatically waived or credited back to their EmaraTax account if it has already been paid.
The initiative is intended for:
Many businesses mistakenly believe that 31 July 2026 is the standard Corporate Tax Return filing deadline.
It is not.
For businesses whose first Tax Period ended on 31 December 2025, the FTA initiative requires the first Corporate Tax Return to be submitted within seven months from the end of the first Tax Period in order to satisfy one of the conditions for the penalty waiver. For these businesses, that seven-month period ends on 31 July 2026.
One of the most common areas of confusion is the difference between the penalty waiver deadline and the standard Corporate Tax filing deadline.
31 July 2026 – Relevant for many eligible businesses seeking to satisfy the seven-month filing condition under the FTA penalty waiver initiative.
30 September 2026 – Standard Corporate Tax Return filing and payment deadline for many businesses with a tax period ending on 31 December 2025.
Meeting the standard filing deadline does not automatically qualify a business for the penalty waiver initiative. Businesses must satisfy the specific conditions set out by the FTA.
Depending on your circumstances:
The AED 10,000 administrative penalty may be waived automatically once the FTA’s conditions are met.
The FTA may automatically credit the amount back to your EmaraTax account. The credited amount can generally be used to settle other tax liabilities or be refunded through the applicable refund process.
Before the applicable deadline, businesses should:
Many businesses unintentionally miss out on the initiative because they:
Planning early can help avoid these issues.
Every business has its own circumstances, including different financial year-end dates, tax periods, and compliance history.
Before relying on the penalty waiver initiative, businesses should ensure they fully understand:
Seeking professional advice can help reduce the risk of missing important deadlines or misunderstanding the applicable conditions.
The FTA’s Corporate Tax Late Registration Penalty Waiver Initiative provides an important opportunity for eligible businesses to reduce unnecessary compliance costs while strengthening voluntary tax compliance.
If your business has received the AED 10,000 Corporate Tax late registration penalty, or if you are unsure whether your company qualifies for the initiative, now is the right time to review your position and take action before the applicable deadline.
